Terms of Service

Last updated: October 30, 2026

Welcome to ConCal. These are the terms you agree to when you use our service. They are the agreement between you and the business that runs ConCal ("ConCal", "we", "us"). We've written them in plain English. If something isn't clear, email us at support@con-cal.net and we'll explain it.

If you already had an account before this date, the changes from the October 22 version take effect 30 days after we email you about them.

1. What ConCal Is

ConCal is a web-based concrete estimating tool built for contractors. It helps you draw job areas on screen, calculate material volumes, and generate cost estimates and proposals, and it helps you run the jobs you win. ConCal is a single subscription plan with a 14-day trial:

PlanPriceBilling
ConCal$44/monthMonthly, auto-renews · 14-day trial

All prices are in USD and do not include applicable taxes.

ConCal is for business use. You use it for your contracting business, not for personal or household use.

2. Your Account

To use ConCal, you need to create an account with a valid email address. Account authentication is handled by Supabase (our backend provider).

  • You're responsible for keeping your login credentials secure.
  • Don't share your account with other people. Each user needs their own login.
  • You must be 18 or older to create an account.
  • You're responsible for everything that happens under your account.
  • If you sign up for a company, you confirm you have the authority to agree to these terms for it. "You" then means you and the company.

3. Your Team and Crew Hours

An account owner can add foremen and workers. They use ConCal under these terms too, and the owner is responsible for how the team uses it and for the permissions the owner gives them.

  • Tell your workers what ConCal records. That includes hours and clock punches, the location of a punch when the worker turns that on, crew sheet photos and receipts. Some states require employers to give written notice or get consent before recording this kind of information. Giving that notice is the employer's job, not ConCal's.
  • ConCal is not a payroll service. It records the punches and hours your team enters. It does not decide what anyone is owed and does not check them against wage and hour laws. You are responsible for paying wages and overtime correctly, for meal and rest breaks, and for keeping the payroll records the law requires.
  • Check hours before you pay. A clock-in that is never clocked out closes by itself after 12 hours and counts until someone fixes it. Edits, forgotten punches and rounding are yours to review.
  • Export your hours and keep your own copy for as long as your state requires you to keep payroll records.

4. Trial

New accounts include a 14-day trial with full access to every ConCal feature. You add a payment card when the trial starts, and nothing is charged during the trial. Unless you cancel before the trial ends, your subscription starts automatically and your card is charged the monthly price (plus any sales tax) on day 15, then every month after. We email you the day before your trial ends. If you cancel, your account is paused (your data is kept, not deleted) until you subscribe again.

5. Billing and Payments

Paid plans are billed through Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service.

  • Auto-renewal: Your subscription renews automatically every month at the price shown when you signed up (plus any sales tax), charged to the card you added, until you cancel.
  • Cancel anytime: Cancel online in a few clicks from Settings, then Manage billing. You don't have to call or email anyone. You'll keep access through the end of your current paid period. We don't cut you off early.
  • Refunds: No refunds once a billing period has started.
  • Failed payments: If a charge fails, Stripe tries again. If it still fails, your subscription is canceled and your account is paused with your data kept.
  • Taxes: Where required by law, we collect sales tax on top of the listed price. The tax amount is calculated at checkout based on your billing location.
  • Price changes: We'll give you at least 30 days notice by email before changing subscription prices.

6. Your Data and Content

Your job estimates, customer information, proposal data, photos, plans, receipts and anything else you put in ConCal is yours. We don't sell it, share it for marketing purposes, or claim any ownership over it.

  • What you let us do with it. You give us permission to store, copy, process and display your content only as needed to run ConCal for you and your team, including sending it to the service providers named in our Privacy Policy, and to show it to the people you choose to share it with (for example a customer you send a proposal to).
  • You have the right to it. Only add photos, plans, documents and other people's information that you have the right to use and share. You're responsible for telling your own customers how you use their information.
  • Keep your own copies. We work hard to protect your data, but no system is perfect. Export your data now and then, and keep your own copy of anything important, such as signed contracts, lien waivers and payroll hours.
  • Export and delete. You can export your data as a JSON file from your dashboard settings at any time. From the same page you can permanently delete your jobs, customers, and proposals. To close your account and erase everything we hold, go to Settings, then Delete my account, or email us at support@con-cal.net and we'll erase it within 30 days.
  • Ideas you send us. If you send us suggestions or feedback, we can use them to improve ConCal without owing you anything for them.

7. Acceptable Use

ConCal is a tool for contractors to estimate and run concrete work. When using it, don't:

  • Scrape, crawl, or automatically extract data from the service
  • Attempt to access other users' accounts or data
  • Share your account login with other users (each person needs their own account)
  • Use the service to do anything illegal or harmful
  • Upload anything you don't have the right to share, or anything that contains malware
  • Send messages through ConCal to people who haven't agreed to hear from you, or use it to buy, filter or fake reviews
  • Try to reverse-engineer, copy, or resell any part of ConCal
  • Abuse our support team or contact channels

Violations may result in your account being suspended or terminated.

8. Estimates Are Tools, Not Guarantees

ConCal helps you estimate concrete volumes and costs faster, but the numbers it produces are tools to guide your bidding, not guaranteed outcomes.

  • ConCal is not a licensed engineering tool. All outputs (including volume calculations, cost estimates, rebar and material quantities) should be verified by a qualified professional (e.g., a licensed engineer or architect) before use on permitted projects or structural work. ConCal does not design or check structures.
  • Prices in ConCal are the ones you enter. Always check current prices with your supplier before you send a bid.
  • Volume calculations assume the dimensions you enter are accurate and do not account for sub-base variation, soil conditions, site grading, over-excavation, or local building code requirements. Field conditions including waste, over-pours, and slump variation will affect actual material usage.
  • Quantities read off a plan or a photo, by you or by an AI helper, can be wrong. Check them against the plans before you bid.
  • It is the user's sole responsibility to ensure all calculations comply with applicable local, state, and federal building codes and regulations.
  • ConCal is not responsible for construction errors, cost overruns, material shortages, structural failures, or any damages resulting from reliance on estimates generated by the tool. You are the professional. Your judgment governs the bid.

9. AI Helpers

Some parts of ConCal use AI (Claude, from Anthropic) to read photos, spoken words and notes and fill in boxes for you. They only run when you tap them.

  • AI results can be wrong. You check them before you save. What you save is yours to stand behind, the same as anything you type.
  • The AI never makes up prices or does the concrete math. Yards and totals come from ConCal's own calculator. Prices come from your price book, or from a supplier sheet you hand it and approve line by line.
  • Only give it photos and text you have the right to use.
  • AI help has a monthly limit per account. When it is used up, you can still type everything in by hand until the next month.
  • What is sent, and how Anthropic handles it, is in our Privacy Policy.

10. Proposals, Signatures, Lien Waivers and Other Documents

ConCal is not a law firm, and nothing in ConCal is legal advice. It gives you tools and sample wording. Your contracts and the rules that apply to them are yours to get right.

  • Sample wording is a starting point. The wording ConCal fills in for you (proposal terms, warranty lines, exclusions, change orders, invoices, lien waivers and the three-day cancel notice) is a general example. You choose the final wording and you are responsible for it, including anything your state or city requires on a contract, such as your license number, required notices, or home improvement contract rules.
  • Lien waivers. Several states require their own exact lien waiver form, and ConCal's general form may not be valid there. Some states or owners also require a notarized or ink-signed waiver. Check what your state requires before you use one.
  • Lien and notice deadlines. The deadlines ConCal shows are counted from the numbers you enter in Settings and from the work days recorded in ConCal. If your numbers or records are wrong or missing, the deadline will be wrong too. Missing a real deadline can cost you your lien rights, so confirm your state's deadlines with a local attorney. ConCal does not file or send any lien or notice for you.
  • Electronic signatures. When someone signs in ConCal, it keeps a record of who signed, when, their agreement to sign electronically, and a fingerprint of the exact document. US law generally treats an electronic signature like an ink one, but some documents and some states have extra rules, and a court decides each case. We can't promise any particular document will be enforced. Offer a paper copy to anyone who asks for one.
  • We are not part of your deals. ConCal is not a party to any contract between you and your customers, general contractors, subcontractors, suppliers or workers, and we don't guarantee that anyone pays you.

11. Messages to Your Customers

When you send a proposal, change order, invoice, reminder, job page or review request through ConCal, it goes out for you, under your company name, even though it comes from a ConCal address or number. Automatic reminders and review requests follow the settings you choose in ConCal.

  • You're responsible for having the right to contact the person, for what the message says, and for following email and text message laws.
  • If someone asks you to stop contacting them, stop, and turn off reminders for them.
  • Don't offer anything in return for a good review, and don't ask only the customers you expect to be happy.

12. Other Services

ConCal relies on other companies to work, such as Stripe, Supabase, Netlify, Resend, Anthropic and Apple (see our Privacy Policy). We aren't responsible for their outages or mistakes, or for websites and services we link to.

13. Changes to ConCal

We keep improving ConCal, so features may be added, changed or removed. If we remove something important, we'll try to tell you ahead of time, and you can always cancel.

14. Termination

You can leave at any time. Cancel your plan from Settings, then Manage billing. To erase your account, go to Settings, then Delete my account. Your data will be permanently removed.

We can terminate accounts for cause. If you violate these terms (particularly around abuse, scraping, or account sharing), we may suspend or terminate your account. If we do so without cause, we'll refund any unused prepaid subscription time.

Sections 6 (the parts about feedback), 8, 10, 15, 16, 17, 18 and 21 keep applying after your account ends.

15. No Warranties

ConCal is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do our best to keep it running reliably, but we can't guarantee 100% uptime, that every calculation or AI result will be error-free, or that data will never be lost.

16. Limitation of Liability

To the fullest extent the law allows:

  • ConCal's total liability to you for all claims about the service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.
  • We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bids, lost revenue, lost or corrupted data, cost overruns, construction defects, missed lien or payment deadlines, or wage claims, even if we were told they might happen.

Some places don't allow some of these limits. Where that's the case, they apply as far as the law allows.

17. Your Responsibility for Claims

If someone makes a claim against ConCal or the people who run it because of your jobs or your work, your bids, contracts or other documents, messages you send through ConCal, your team's hours and pay, content you upload, or your breach of these terms or the law, you agree to defend us and cover the losses and costs that result, including reasonable attorney fees.

18. Disputes

  • Talk to us first. Before you bring any claim, email support@con-cal.net with what happened and what you want. We'll try to work it out within 30 days. We'll do the same for you.
  • One at a time. To the extent the law allows, claims must be brought individually, not as part of a class or group action.
  • Time limit. To the extent the law allows, any claim must be brought within one year after it arises.
  • Small claims. Either of us can still bring a qualifying claim in small claims court.

19. The ConCal Field iPhone App

If you use the ConCal Field app from Apple's App Store, these terms also apply to it, and:

  • These terms are between you and ConCal, not Apple. ConCal, not Apple, is responsible for the app and its content.
  • Apple has no duty to provide support or maintenance for the app.
  • If the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app, if any. Apple has no other warranty duty for the app.
  • Apple is not responsible for any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone else's rights. ConCal handles those.
  • You confirm you are not in a country under a US government embargo and are not on a US government list of prohibited or restricted parties.
  • You also follow Apple's App Store terms when you use the app.
  • Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.

20. Changes to These Terms

If we make material changes to these terms, we'll send you an email at least 30 days before the changes take effect. Continuing to use ConCal after that date means you accept the updated terms. We'll always keep the current version here at con-cal.net/terms.

Minor changes (typos, clarifications that don't affect your rights) may be made without notice.

21. Governing Law and General Terms

These terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles. Any disputes will be handled in the state or federal courts located in South Dakota.

  • These terms and our Privacy Policy are the whole agreement between us about ConCal.
  • If a court finds part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a part of these terms right away, we can still enforce it later.
  • We can transfer these terms to a company that takes over ConCal. You can't transfer your account without our OK.
  • We aren't responsible for delays or failures caused by things outside our reasonable control, such as outages at our providers, internet failures, or natural disasters.
  • We send notices to the email address on your account. You send notices to support@con-cal.net.
Questions about these terms? Email us at support@con-cal.net and we'll get back to you.
